Can Your Employees’ AI Chats Be Subpoenaed? What Every Business Needs to Know

Here’s a question more business owners should be asking: “If my employees type company information into ChatGPT, can that come back to hurt us later?”

The short answer is yes. And if that surprises you, you’re not alone.

A recent survey found that half of AI users had no idea their chatbot conversations could be subpoenaed in court. Two-thirds believed their AI chats had the same legal protection as a conversation with a lawyer or doctor. They don’t.

What Does “Subpoenaed” Actually Mean?

A subpoena is a legal order that forces a person or company to turn over documents, records, or testimony for use in a court case. It can happen in criminal cases, civil lawsuits, and even workplace disputes.

When we say AI chat conversations can be subpoenaed, we mean that the things you or your employees type into tools like ChatGPT, Claude, Gemini, or Copilot can be requested as evidence. That includes the prompts you wrote, the responses you got back, and in many cases, chats you thought were deleted.

This Isn’t Hypothetical. It’s Already Happening.

In February 2026, a federal judge in New York ruled that a fraud defendant had to hand over 31 documents he generated through an AI chatbot. The court’s reasoning was straightforward: AI chats are not protected by attorney-client privilege. They’re regular records, just like emails or text messages.

In another case, a federal court ordered a major AI company to preserve all user chat logs, including conversations users thought they had deleted. In plain language: even “deleted” chats may still exist, and a court can force the company to produce them.

Law enforcement has several ways to get these records. They can get a search warrant. They can issue a subpoena to the AI company under federal law. Or they can simply find the conversations on an employee’s phone or laptop during a legal search of the device.

Why This Should Worry Business Owners

Most employees don’t think twice about pasting something into an AI chatbot. They’re trying to get work done faster. But here’s what that actually looks like from a legal or security standpoint:

  • An employee pastes a draft contract into ChatGPT to “make it sound better.” That contract is now stored on a third-party server and could be produced in a future lawsuit.
  • A manager types out an employee complaint into an AI tool to help draft a response. That record could later be subpoenaed in a wrongful termination case.
  • A salesperson uses AI to analyze a list of customers or a competitor’s pricing. That information is now outside your control, and could be requested as evidence in an unfair competition dispute.
  • A finance employee runs numbers through an AI tool during an internal disagreement. Those chats could show up in litigation, a regulatory investigation, or even an acquisition due diligence review.

None of these employees did anything malicious. They were just trying to do their jobs. But the records they created now live outside your business and may be accessible to anyone with a legal right to request them.

What the AI Companies Actually Say

Most people assume there’s some level of privacy when they use an AI chatbot. The fine print says otherwise.

The privacy policies of major AI platforms generally say two things clearly: the company can share user data with third parties in certain situations, and users should not expect privacy in what they type into the tool. That’s true even for paid consumer plans.

Business and enterprise versions often offer stronger protections, including agreements not to train on your data and better retention controls. But the underlying legal reality doesn’t change. If a court orders the company to produce records, it will produce them.

What Your Business Should Do About It

You don’t need to panic, and you don’t need to ban AI across your company. What you need is a clear plan. Here are five steps that protect your business without stopping your team from being productive.

1. Write an AI usage policy. This is step one. Your policy should say which AI tools are approved, what kinds of information can be typed into them, and what absolutely cannot. If you don’t have one, your employees are making these calls on their own every day.

2. Use business or enterprise AI tools, not free consumer accounts. The differences matter. Enterprise versions of tools like Microsoft Copilot, ChatGPT Enterprise, and Claude for Work offer better data controls, stronger privacy agreements, and clearer terms about how your data is handled.

3. Train employees on what not to paste. Most employees will follow the rules if they understand them. The things that usually should not go into a public AI tool include customer data, employee information, financial records, legal matters, trade secrets, and any communication you wouldn’t want read aloud in a courtroom.

4. Assume everything is discoverable. This is the mindset shift that matters most. Treat AI chats the same way you treat email. Professional, factual, and aware that anything you type could be read by someone else someday. If your employees wouldn’t put it in an email to a client, they shouldn’t put it in an AI chat.

5. Talk to your lawyer. Every business is different. Your industry, your contracts, your data, and your specific risks all matter. A short conversation with your attorney about how AI fits into your document retention and legal strategy is time well spent.
